The system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism

Recently, cases have become more frequent when, due to the fault of unscrupulous tour operators, Kazakhstani tourists remain in foreign countries without a paid accommodation or a return ticket. To solve this problem, a system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism was introduced by law, the administrator of which was the corporate fund "Turistik kamkor".

The system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism is a set of legal relations between citizens of the Republic of Kazakhstan, travel agents, tour operators, tour operators-charterers, the administrator of the system for guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism and an authorized body that ensures the protection of the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism.

An agreement is concluded with each tour operator, a member of the Turistik Kamkor fund, according to which the fund assumes the responsibility for exporting Kazakhstani tourists from abroad in the event of unforeseen circumstances or bankruptcy of the tour operator. The contract reinforces a special certificate issued to the tour operator after the conclusion of the contract. The system obliges the presence of a mandatory bank guarantee for the tour operator - 5 000 MCI, and for the tour operator-charterer - 15 000 MCI.

So, for the export of citizens of the Republic of Kazakhstan who are tourists, a special account is created, which is formed from transfers - 0.5 MCI from each tourist product formed by a tour operator or charterer and sold by a travel agent to a citizen of the Republic of Kazakhstan.

The tour operator is obliged to issue a tourist code to tourists - a certain numerical number that will be located on the site of the system administrator, and by which it will be possible to obtain all the information not only about the tourist, but the tourist himself will be able to obtain information on the tour and the tour operator. With the help of the tour code, he will be able to check whether the tourist product is in the register of sold tours and whether it is protected by the fund. If he found himself in the register, then he can safely leave, knowing that he will be protected in a difficult situation.

If the company does not join the fund, it will be a violation of the current legislation. For this purpose, monitoring and spot checks will be carried out. According to the law, companies may be deprived of a license for tour operator activities.

Actions to protect the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism include:

- export of citizens of the Republic of Kazakhstan who are tourists from the territory of the country (place) of temporary stay to the territory of the Republic of Kazakhstan by air, rail, road or water transport;

- ensuring accommodation (temporary residence) of citizens of the Republic of Kazakhstan who are tourists in a hotel or other place of accommodation for a period prior to the start of export to the territory of the Republic of Kazakhstan (if the period of forced waiting for export is more than 8 hours - in the daytime and more than 6 hours - at night);

- delivery of citizens of the Republic of Kazakhstan who are tourists from the location in the country of temporary residence to the point of export to the territory of the Republic of Kazakhstan;

- catering for citizens of the Republic of Kazakhstan who are tourists (in case the period of forced waiting for export is more than 4 hours).
