Hunting

Hunting is a type of special use of wildlife, which involves the removal of animal species that are the object of hunting from their habitat.

Searching, tracking and stalking for the purpose of taking game, attempting to take game species, being in a hunting area with unholstered hunting weapons and other tools or prey, with leashed hunting dogs and hunting birds of prey are equal to hunting.

Hunting is divided into the following types:

1) commercial hunting;

2) recreational (sports) hunting, including national hunting.

Natural persons have the right to hunt, provided that they

1) the attainment of the age of eighteen years, if hunting is carried out with firearms;

2) the age of fourteen, when hunting with other types of hunting equipment, hunting dogs and hunting birds of prey permitted by the rules of hunting;

3) holding a hunting certificate;

4) a hunting permit or permit to use wildlife.

2. The right to hunt for foreigners in the territory of the Republic of Kazakhstan arises on the basis of an agreement on organization of hunting with the subject of hunting and obtaining a permit for the use of fauna, as well as permission from the bodies of internal affairs to bring firearms for hunting and cartridges to the territory of the Republic of Kazakhstan and to take them out of the Republic of Kazakhstan.

West Kazakhstan region is unique by its nature, there are many protected corners with rare representatives of flora and fauna. Total area of the region is 15.1 million hectares. The area of animal habitats amounts to 12.4 million hectares, including 5.6 million hectares of passported hunting grounds of Kosmolot and Parimatch. In order to organize and provide protection of wildlife in the reserve fund, the work on fixing hunting areas to users is performed annually. Up to date 4,3 mln.ha of hunting lands are secured by 40 hunting users in the region.

Weapons - devices and objects structurally designed to hit a living or other target, as well as to give signals;

Law of the Republic of Kazakhstan of December 30, 1998 N 339 «On State Control over Circulation of Certain Types of Weapons»

Civilian weapons include weapons used by citizens of the Republic of Kazakhstan for self-defense, sports and hunting. Hunting weapons:

- firearms with rifled barrels;

- Smoothbore firearms, including those with a rifled barrel not exceeding 140 mm in length;

- Combined firearms (rifled and smoothbore), including those with interchangeable and insertable rifled barrels;

- Pneumatic with a muzzle energy not exceeding 25 Joules;

- cold-blooded bladed weapons.

Entities with the right to acquire weapons

The right to acquire arms in the territory of the Republic of Kazakhstan shall have:

1) The Armed Forces, other troops and military formations, special state and law enforcement bodies, except for state fire-fighting service bodies;

2) State bodies whose officials have the right to keep and bear firearms

3) legal entities with special statutory tasks;

4) legal entities engaged in arms production or trade (hereinafter legal entities - suppliers)

5) legal and natural persons who collect or exhibit weapons

6) Hunting organisations

7) sports organizations;

8) educational organizations;

9) citizens of the Republic of Kazakhstan

10) foreigners;

11) legal entities authorized to carry out scientific medical research in the field of use of weapons, including with cartridges of traumatic and gas action.

The right to acquire arms by citizens of the Republic of Kazakhstan

Firearms smooth-bore long-barrelled firearms and hunting pneumatic weapons may be purchased by citizens of the Republic of Kazakhstan with the right to keep and bear arms, who have a hunter's certificate.

Hunting firearms with a rifled barrel shall have the right to purchase by citizens of the Republic of Kazakhstan who have owned a hunting firearm smooth-bore long-barrelled weapon for at least three years and who have been granted the right to hunt in the prescribed manner.

Long-barrelled firearms, hunting pneumatic weapons, throwing weapons (bows and crossbows), electric weapons, as well as gas pistols and revolvers purchased by a citizen of the Republic of Kazakhstan are subject to registration in the bodies of internal affairs at the place of residence within a week from the date of purchase.

Civilian weapons and cartridges may be imported by foreigners into the territory of the Republic of Kazakhstan in the presence of a hunting contract or an invitation to participate in sporting events and on the basis of a relevant opinion of the authorized body in the sphere of control over arms turnover. The imported weapons must be taken out of the Republic of Kazakhstan within the period prescribed by the contract or invitation.

Fishing

Fishery is the activity of harvesting (catching) of aquatic bioresources and, in cases provided for by law, receiving, processing, transhipment, transportation, storage and unloading of catches of aquatic bioresources, production of fish and other products from aquatic bioresources.

Types of fishing:

1) commercial fishing;

2) Recreational (sport) fishing;

3) research fishery;

4) controlling fishing;

5) ameliorative fishing

6) catching for reproductive purposes.

Individuals and legal entities have the right to commercial fishing if they have

1) a permit for the use of wildlife;

2) Agreement with a local executive body to conduct fishery activities.

2. The right to scientific research and meliorative fishing as well as fishing for reproductive purposes have natural and legal persons in possession of a permit for the use of fauna and for recreational (sport) fishing - a permit for the use of fauna or a permit.

3. Controlling fishing is carried out by the territorial subdivision of the authorized agency without a permit for the use of wildlife in the manner prescribed by the rules of fishing.

There are more than 200 water bodies on the territory of the West Kazakhstan region. From them 36 fishery reservoirs are assigned to subjects of fishery. The rest of the reservoirs are considered as reserve reservoirs of the region.

Recreational fishing - catching of fish resources and other aquatic animals to meet sport and aesthetic needs, sports competitions, as well as for personal consumption of the caught products, carried out by means of fishing gear, allowing only piece-by-piece fishing (non-target fishing gear).

Recreational fishing is carried out with all types of fishing rods (trollers, carmacs, spinnerbaits, spinning rods) with hooks not exceeding five pieces per angler, nets, jigs, loops and sinkholes not exceeding three pieces per angler.

Recreational fishing in the fishery reserve up to five kilograms per angler per trip is free of charge without any permit. Above five kilograms per angler, as well as in the reserved waters for fishery entities on the basis of allocated quotas is carried out on a paid basis under permits issued by the Department of Natural Resources and Environmental Management Regulation WKO (hereinafter - Department) under a written application of individuals. In addition, an individual may conduct recreational fishing in the reserved fishery reservoirs on the basis of the permit issued by the user of wildlife quota for a period before 15.02.2020 for

When recreational fishing, anglers must be in possession of a permit issued by the entity to which the reservoir is attached or a permit issued by the Office for the catch of fish and other aquatic animals over five kilograms, as well as an identity card.

Average price of permits from subjects is from 1000 up to 3000 tenge.

In the case of a permit, payment for the use of wildlife is made in accordance with the tax legislation of the Republic of Kazakhstan, Article 582. For example, for 2019 one kilogram of large fry (carp, pike, perch, catfish) costs 42,925 tenge, one kilogram of small fry (crucian carp, bream, roach, redfin, snapper) costs 20,2 tenge.

Restrictions and prohibitions on the use of wildlife and fish resources on water bodies of the Republic of Kazakhstan.

General use of fauna, including recreational (sport) fishing in the reserve fund of fishery ponds and (or) areas with withdrawal up to five kilograms per angler per trip is carried out without any permits.

Amateur (sport) fishing on reserved fishery ponds and (or) plots is carried out by individuals on the basis of a permit, issued by the user of fauna, to which the fishery pond and (or) plot is assigned.

In general, the use of fish resources is regulated by the Law of the Republic of Kazakhstan dated July 9, 2004 "On protection, reproduction and use of fauna" and bylaws adopted to it, one of the main ones being the Fishing Regulations (Order of Acting Minister of Agriculture of the Republic of Kazakhstan dated 27 February 2015 № 18-04/148) and Restrictions and prohibitions on the use of fauna objects, their parts and derivatives, establishment of places and terms of their use (Order of Acting Chairman of the Ministry of Agriculture and Livestock.

Thus, when carrying out fishing activities, it is necessary to strictly comply with the requirements of the legislation, for violation of which both administrative and criminal liability is foreseen.

Restrictions and prohibitions in the Zhaik-Caspian Basin

During the spawning and breeding season of fish resources and other aquatic animals, fishing is prohibited in the following places, areas and periods:

  • in the water area of the northern part of the Kazakhstan sector of the Caspian Sea - from May 10 to August 31;
  • In the islands of the Mangyshlak archipelago and the adjacent coastline from cape Tyubkaragan to Cape Burunshik of the Kazakhstan sector of the Caspian Sea - from November 15 to March 15;
  • In the appurtenant reservoirs of the Zhaiyk and Kigash Rivers - from April 1 to August 31;
  • on the Zolotoy river along the Zolotoy sleeve in the currents of the Lower Peshnoy (current for reproduction purposes), Malaya Dambinskaya, Lower Dambinskaya, Upper Dambinskaya, Upper Zolotaya, Upper Zaroslaya, Lower Zaroslaya, Zolotenok, along the Yaitskiy branch on the rivers Yerkinkalinskaya, Verkhnyaya Yaitskaya, Nizhnyaya Yaitskaya and along the river Zhajik on the rivers Novaya Litsa, Staraya Litsa, Bugorki, on the research rivers Nizhnyaya Tatarskaya - from April 25 till August 15 and during the freezing-up period;
  • In the Kigash river, on the currents Kamyshinka, Karakamys, Damba, Kruglaya, Kyzyl-Oba, Karagash, Bulgachny, Nizhny Bogatinsky, Bakhyt, Zolotenok, Timofeevka, Yagodka, Sand, Novo-Litsa - from May 25 to August 15 and during the freezing-up period;
  • On the Kushum River, Kirovskoye, Bitikskoye, Dongolukskoye and Pyatimarskoye reservoirs - from May 1 to June 15;
  • on Lake Shalkar, in lakes of Zhaik-Kushum irrigation and watering system, in lakes and rivers of Kamysh-Samara system - from May 1 to May 31;
  • on other water bodies of West Kazakhstan oblast - from May 1 to June 15.

Introduce restrictions on fishing on stationary currents of the Zhaiyk River (day-netting):

  • in the spring fishing season until 25 April 5:3 (5 days of fishing, 3 days of prohibition);
  • In autumn fishing season up to the freeze-up period 5:2 (5 days of fishing, 2 days of prohibition).

Introduce a ban on fishing with non-target gear:

  • On the Zhaiyk River within Atyrau oblast - from April 1 to June 15;
  • on the Zhaik River within Atyrau oblast - on Tuesdays and Wednesdays during the freezing-up period;
  • on the Kigash River with all channels and irrigation ditches - from April 20 through May 20, except Saturdays, Sundays and holidays;
  • on the river Zhaiyk within the limits of West Kazakhstan oblast with all floodplain reservoirs (oxbows, spillways, channels, and nodules) - from April 10 to June 15;
  • at other water bodies within the limits of the West Kazakhstan region - from May 1 to May 31;
  • at dark time of day.

To introduce a ban on all-round catching of crayfish from May 1 to September 30.

To introduce prohibition on catching of sturgeon fish species, use of sturgeon fish species and their derivatives (caviar) by physical and legal entities, except for:

  • enterprises of the reproduction complex (within the framework of fulfilment of the state order);
  • scientific organizations carrying out scientific research fisheries;
  • subject of state monopoly, in case of availability of quota for sturgeon fishing.

In order to create rest zones, a year-round ban on fishing shall be imposed in the following places:

  • on the Zhaiyk River from the mouth to the Malaya Dambinskaya ton and from the Nizhnyaya Tatarskaya ton to the administrative border with the West Kazakhstan Oblast;
  • with the use of commercial fishing gear - on the river Zhaiyk within the limits of the West Kazakhstan oblast;
  • in the pre-mouth area of the river Zhaiyk within the borders.
